As an update to our previous newsletter (No. 14 of May 2016) on the subject, the amendments to the articles of the Mexican Industrial Property Law (IPL) introducing trademark opposition proceedings were published in the Federal Government Gazette on June 1, 2016.Our May newsletter provided detailed analysis of the amendments, which will come into force within 90 calendar days of June 1. This means that the Mexican trademark opposition system will be in operation as of August 30th, 2016.In the meantime, the Tariff of the Mexican Institute of Industrial Property (IMPI) needs to be amended to include the official fees for filing or responding to an opposition.
We are currently working on securing the most efficient watch service for tracking oppositions so that our clients receive timely notice.
We will revert once the Tariff is amended and, based on the new fees, we will provide our clients with opposition quotations.
